1. Voluntary Service; No Compensation or Employment
I freely offer my services to support the charitable and community mission of Aire & Ease and any other event organizer identified (collectively, the "Organizer"). I understand that I am a volunteer, not an employee, independent contractor, agent, partner, or representative of the Organizer. I have no expectation of wages, salary, benefits, insurance, workers' compensation, unemployment benefits, future employment, or other compensation. Any approved reimbursement or nominal item of appreciation does not change my volunteer status. I may stop volunteering at any time, and the Organizer may end or change my assignment at any time, with or without cause or notice.
2. Duties, Training, and Conduct
I will perform only assigned or approved duties; follow all Organizer policies, procedures, safety instructions, privacy requirements, and supervisor directions; act professionally and respectfully; and promptly report injuries, hazards, participant complaints, suspected abuse, threats, privacy incidents, or misconduct. I will not provide any professional services, counseling, clinical advice, untrained or uncertified assistance, or other services unless specifically authorized. I will not possess, use, distribute, or be under the influence of alcohol, illegal drugs, marijuana, or unauthorized controlled substances on event premises or while performing volunteer duties.
3. Confidentiality and Participant Information
I may learn private or confidential information about participants, families, donors, staff, volunteers, referral providers, grants, operations, or finances, including names, contact details, service needs, counseling or health information, photographs, records, and other personally identifiable information ("Confidential Information"). I will access and use only the minimum information necessary for my assigned duties and only for an Organizer-authorized purpose. I will not discuss, copy, photograph, screenshot, post, transmit, retain, remove, or disclose Confidential Information to anyone, including family, friends, other volunteers, or on social media, unless specifically authorized or legally required.
The Volunteer shall comply with HIPAA, 42 C.F.R. Part 2, all other applicable privacy laws, and the Organizer's confidentiality policies. Any unauthorized access, use, copying, disclosure, transmission, or release of participant information is strictly prohibited and must be reported to the Organizer immediately. A violation may result in immediate removal from service and may subject the Volunteer to legal liability and responsibility for resulting damages, costs, or penalties to the fullest extent permitted by law. These obligations continue after the Volunteer's service ends.
4. Data Security and Required Reporting
I will use only Organizer-approved forms, accounts, devices, and communication methods; keep paper and electronic records secure; protect passwords; verify recipients; and immediately report any loss, misdirection, unauthorized access, disclosure, or suspected breach. I will not store participant information on a personal device or personal cloud account unless expressly authorized. At the end of my assignment or upon request, I will promptly return or securely destroy all Organizer property and information and retain no copies. These confidentiality obligations continue after my volunteer service ends. Nothing in this Agreement prohibits a report required by law, a good-faith report of suspected abuse or danger, or cooperation with lawful authorities; when practicable, I will notify the Organizer before disclosure.
5. Participant Referrals and Boundaries
I will not promise services, eligibility, funding, confidentiality beyond what the Organizer authorizes, or a particular referral outcome. I will gather and route information only through approved processes and will refer participants to designated staff or service providers. I will maintain appropriate boundaries, avoid conflicts of interest and exploitation, and will not solicit participants for personal, political, religious, commercial, romantic, or financial purposes. I will not accept significant gifts or money from participants.
6. Photo, Video, and Audio Release
I authorize the Organizer and its designees to photograph, film, livestream, audio record, or otherwise capture my image, likeness, voice, statements, and volunteer activities. I grant a worldwide, perpetual, royalty-free right to use, reproduce, edit, publish, distribute, and display those recordings in any media for lawful promotional, educational, informational, grant, fundraising, archival, and public-relations purposes. I waive inspection or approval and understand that I will receive no compensation. To the fullest extent permitted by law, I release the Organizer from claims arising from authorized uses.
7. Assumption of Risk and Emergency Care
I understand that volunteer activities may involve known and unknown risks, including injury, illness, death, emotional distress, travel, interaction with the public, property damage, theft, and acts or omissions of others. I knowingly and voluntarily assume all risks related to my service, whether foreseeable or unforeseeable. If I become injured or ill, I authorize the Organizer to obtain emergency assistance when reasonably believed necessary, understand that the Organizer is not required to provide medical care, accept responsibility for related costs, and release the Organizer from liability or responsibility related to my health or injuries that may occur.
8. Release and Waiver of Claims
I release, waive, discharge, and covenant not to sue the Organizer and its nonprofit, affiliated entities, directors, officers, employees, volunteers, agents, sponsors, vendors, contractors, successors, assigns, and event-site owners or operators (collectively, the "Released Parties") from claims, demands, causes of action, damages, liabilities, costs, or expenses arising from or related to my volunteer service, including claims based on a Released Party's ordinary negligence, except to the extent liability cannot lawfully be waived.
9. Indemnification and Hold Harmless
To the fullest extent permitted by law, I will defend, indemnify, and hold harmless the Released Parties from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from or related to my acts or omissions; violation of law or Organizer rules; breach of confidentiality, privacy, data-security, or other obligations; unauthorized promises or representations; or damage or injury I cause. This obligation does not apply to conduct or liability that cannot lawfully be indemnified.
10. Property, Expenses, and Transportation
The Organizer is not responsible for loss of or damage to my personal property, vehicle, equipment, money, or belongings, except as required by law. I am responsible for my own expenses unless the Organizer approves reimbursement in writing beforehand. If authorized to drive for an assignment, I will maintain a valid license, legally required insurance, and a safe vehicle; obey traffic laws; and will not transport a participant unless specifically authorized.
11. Authority, Property, and Work Product
I may not sign contracts, incur expenses, make commitments, speak to the media, use the Organizer's name or logo, collect money, access restricted records, or otherwise bind or represent the Organizer unless expressly authorized in writing. Organizer materials, records, access credentials, equipment, and supplies remain Organizer property. To the extent permitted by law, materials I create within my assigned duties for the Organizer will belong to the Organizer; I grant any rights reasonably necessary for the Organizer to use them for its mission.
12. Compliance, Removal, and Continuing Obligations
The Organizer may reassign, restrict, suspend, or remove me from any activity for safety, privacy, conduct, operational, or other legitimate reasons. Ending my service does not end obligations concerning confidentiality, privacy, media rights already granted, return of property, ownership, release, indemnification, or other provisions intended to survive.
13. Governing Law; Entire Agreement; Severability
This Agreement is the complete agreement concerning my volunteer service and replaces prior oral statements on these subjects. Changes must be in a writing signed by the Organizer. It will be governed by the laws of the State of Alabama, without regard to conflict-of-law principles. If any provision is unenforceable, it will be modified only as necessary to make it enforceable, and the remaining provisions will remain effective. No waiver of one breach is a waiver of another.
Acknowledgment
I HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND SIGN IT VOLUNTARILY. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND THAT MY CONFIDENTIALITY OBLIGATIONS CONTINUE AFTER MY SERVICE ENDS.
